CALQ Volume 4 Issue 4 | Interview with J. Shiva Kirti Singh.

In this interview, Justice Singh although inclined towards the collegium system, rightly opined that the no system can be categorized as good or bad, it is the people manning the system who make the difference. He agreed on certain aspects like having a mandatory cooling off period post retirement for judges, having a separate court of appeal as an adjunct to share the burden of SC and that conducting an All India Judicial Services Examination would upgrade the lower judiciary.

He further suggested that “Judicial activism is required to ensure that where there is a right, there is a remedy. It must not be a tool/ device to for creation of new rights.”
